The administration that came into office in the CHP through a decision of absolute nullity is convening the Party Assembly (PM) today under the chairmanship of Kemal Kılıçdaroğlu.
A highly critical development took place prior to the meeting.
Twenty-eight of the 57 members of the Party Assembly, acting alongside the elected CHP leader Özgür Özel, have resigned.
Thus, pursuant to Article 24/3 of the Party Statute, both the Party Assembly and the Central Executive Board (MYK) elected from within it have officially fallen.
THE STATUTE SAYS 'CONVENTION IMMEDIATELY'
According to the Party Statute, if the number of Party Assembly members falls below two-thirds (40) of the full number of members, it is mandatory to hold a convention within 45 days.
Article 24/3 in the CHP Statute reads as follows: "Vacated memberships in the Party Assembly are filled by substitute members in order of precedence. After all substitute members have been called to the Party Assembly, if the number of members falls below two-thirds (2/3) of the full number of members, the Chairman shall call the convention to a meeting within forty-five (45) days for elections to the Party Assembly to be held."
ZEYNEL EMRE: FAILING TO CONVENE THE CONVENTION IS A CRIME
Zeynel Emre, the spokesperson for the administration of the elected leader of the CHP, Özgür Özel, made a statement in the Grand National Assembly of Türkiye.
Zeynel Emre said, "We were going to attend the Party Assembly meeting. We thought, let us go there, we are the majority, and there we could once again explain face-to-face to both our former Chairman and our colleagues there the pessimism and objection of millions of CHP members, as well as the possible consequences, and have an extraordinary convention decision passed. However, as of yesterday, they made an announcement stating that nine of our colleagues had been referred to the disciplinary board in an unauthorised manner."
Pointing to "Article 24/3" in the CHP Statute, Emre continued as follows: "From this moment onwards, failing to convene the convention is a crime. If the remaining colleagues there insist on this, they will also commit the offence of 'irregular assumption of duty'. They cannot take any action or make any decisions other than leading the party to a convention."
Making a call to the Court of Cassation, Emre used the following expressions: "Render a decision regarding this file as soon as possible. Let our citizens, and us, say 'there are judges in Ankara'. Let this crisis experienced by our country remain as a black mark in our history, and let us never experience such crises again."
WILL THE PARTY ASSEMBLY CONVENE?
The CHP Headquarters, which came into administration via a decision by the Ankara Regional Court of Justice, once again put forward the "injunction" card. Arguing that the court's injunction decision created a "state of emergency", CHP executives close to Kılıçdaroğlu commented, "The Party Assembly can function even if five people remain."
To the question, "Will it still be held despite the resignations?" regarding the Party Assembly scheduled for 13:00, the Kılıçdaroğlu wing replied, "We will hold our meeting. We have set out on a path, we will not take a step back." Kılıçdaroğlu’s executives reinforced the allegations that controversial practices would continue by saying, "We cannot be expected to take ordinary decisions during extraordinary periods."
“THEY ARE DELIBERATELY CAUSING HARM”
Party members close to the CHP leader Özel, on the other hand, stated that all decisions signed after the absolute nullity, which are deemed "unlawful" — including the expulsion decisions — would be taken to the judiciary. Stating that the Kılıçdaroğlu wing "is acting in line with the agenda placed before them by the Palace", the CHP members said, "They are deliberately and knowingly harming both the party and the country."
